A dissolution is a civil proceeding that terminates the martial relationship. This process is used when the spouses agree on all of the issues (division of their assets and debts, spousal support, and, if there are minor children, child custody, parenting time (visitation), and/or child support). A shared parenting plan may be prepared where appropriate.

The signed separation agreement is then attached to a petition for dissolution of marriage and filed with the court. There is a thirty-day waiting period after the filing of the petition. The court will grant the dissolution between thirty and ninety days after the petition is filed. However, if the parties reached their agreement through the Collaborative Law process, the court will grant the dissolution at any time but no later than ninety days after the petition is filed.

If either spouse is dissatisfied with the separation agreement or does not desire the dissolution, the court will dismiss the petition. At any time before the dissolution is granted, either spouse may convert the dissolution proceeding into a divorce proceeding.
